1.3.1 providing jobseekers (

) on the Site by entering certain information including, contact details, experience, personality information and job search preferences;
1.3.2 providing the ability for third party recruiters (
) to filter and/or search for suitable Talent for job roles that they are recruiting for;
1.3.3 the introduction of suitable Talent and Recruiters to each other (
1.3.4 providing Talent with opportunities to complete online personality psychometric tests (
) and any additional recruiter tests or video interviewing to the extent such processes are required by the Recruiter;
These Terms (together with any further documents or policies expressly referred to herein) set out the legal terms and conditions on which we operate the Site and provide the Services. By using the Site and/or creating a Profile, you (
) confirm that you accept and agree to be bound by the Terms in relation to your access to and use of the Site, the Services and any further content or External Materials (as defined in clause 10.3 below) provided to you through the Site. If you do not accept and agree to these Terms, you must not access or use the Site or the Services. We recommend that you print a copy of these Terms for your future reference. You are also responsible for ensuring that any persons who access the Site using your internet connection are aware of these Terms and that they comply with them.

We may amend these Terms from time to time. Every time you wish to use the Site and/or the Services, please check these Terms to ensure you fully understand those that apply at that time.
CHANGES TO THIS SITE
We fully reserve our right without limitation (and without liability to you or any third party) and without notice to develop, modify, add to, remove from, suspend, or discontinue temporarily or permanently the Site and/or the Services (including your Profile) from time to time.
Further, we do not guarantee that the Site, the Services, or any further content (including the External Materials) on the Site, will always be available or be uninterrupted.
In order for you to create a Profile, we require that you provide a valid email address. The email you use must be one where we can reach you. You are solely responsible for any and all use of your Profile. You permit us to share information in your Profile with prospective employers, Recruiters, and others. Subject to visibility settings that you control, subscribers to services we may introduce (including Recruiters) will be able to view information on your Profile.
Your Profile may be displayed to Recruiters if your Profile matches their search requirements
Your email address and Profile information will be made available to the relevant Recruiter once you have granted permission.
As part of the recruitment process, a Recruiter may invite you to participate in its pre-recorded video interviewing process and/or complete any additional psychometric tests (Recruiter Tests).
If you are successful in your application, the Recruiter will contact you directly to arrange the next steps.
We will only use any personal information you provide to us in accordance with our
By accessing the Site and using the Services, you represent and warrant that:
5.7.1 all information (in any form whatsoever and including personal information) submitted by you in creating or updating your Profile, including your responses to any Recruiter Tests(your Information) is truthful, accurate and not misleading and you will maintain the accuracy of your Information and remove or amend it when it is no longer accurate;
5.7.2 you own all of your Information or otherwise have the right to submit it for display or publication on the Site and to grant the licence set out at clause 6.2 and that the display or publication on the Site of your Information does not violate the privacy rights, copyright, contract rights or any other rights of any person, or otherwise breach any injunction, order or other legal ruling;
5.7.3 your Information is not in any way (and could not reasonably be interpreted as being) threatening, abusive, malicious, pornographic, obscene, defamatory, illegal or otherwise inappropriate for publication on the Site; and
5.7.4. you are 18 years of age or older.
Any breach of clause 5.7 is likely to result in your right to use this Site ceasing automatically and with immediate effect (and may result in legal action being taken against you).
In creating a Profile, you will be asked to use your email address for passwordless login. You are entirely responsible for maintaining the confidentiality of your email account. You agree not to use the Profile or details of another Member (or any third party) at any time or to disclose your access information to any third party. You agree to notify us immediately by emailing firstname.lastname@example.org if you suspect any unauthorised use of your Profile. You are solely responsible for any and all use of your Profile.
The Intellectual Property Rights in all software, text and visual content made available to you (including but not limited to rights in our assessment testing) on this Site shall remain at all times the property of Zigzag (and its licensors). Such rights are protected by intellectual property and copyright laws and treaties around the world. All rights are expressly reserved by Zigzag (and its licensors).
The Intellectual Property Rights in your Information shall remain at all times the property of you (and your licensors). By submitting your Information for display or publication on the Site, you grant to Zigzag a worldwide, sub-licensable, perpetual, transferable, non-exclusive, royalty free licence to use your Information in any way whatsoever including (without limitation) the transmission and distribution of your Information on and through the Site and the sharing of your Information with Recruiters.

You may link to the Site’s home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

8.1.1 impersonate another person, or his or her email address, or misrepresent your current or former affiliation with an employer; or
8.1.2 create user accounts and a Profile under false or fraudulent pretences; create or use an account for anyone other than yourself;
You may store, display and print off one copy of any content supplied on the Site solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Site
You must not modify the paper or digital copies you have printed off or downloaded (in accordance with clause 8.1) in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Further, our status and that of any identified contributors as the authors of content on this Site must always be acknowledged.
We offer access to this Site to Talent for personal use only. You agree not to use this Site, the Services or any content or copies of the content provided via the Site in connection with any business or commercial enterprise without an express written licence to do so from us and/or our licensors (as appropriate).
We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity that you may suffer in relation to your use of this Site and/or the Services.
You may use the site for lawful purposes only. You may not use the Site and/or the Services:
8.6.1 in any way that breaches any applicable local, national or international law or regulation including (without limitation) laws relating to discrimination, employment and human rights;
8.6.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; or

The Site and the Services are provided to you free of charge, although we reserve our right to introduce a charge for the Services. LEGAL DISPUTES, LAW AND JURISDICTION
We would rather attempt to resolve any dispute with you through good faith discussions before resorting to legal proceedings. These Terms are governed by the laws of England and Wales. This means that any dispute or claim arising out of or in connection with these Terms will be governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
